For Improvement to and Redetermination of Benefits for Judicial Ditch 3 Main and Branch E Yellow Medicine and Lyon

Notice is hereby given that a petition has been filed with Drainage

Authority of Judicial Ditch 3 YM&L. Specifically the Main and Branch E. The affected properties and landowners are as follows:

* Portions of Townships 25, 26, 35, 36 of Sandnes Township in Yellow Medicine County. Landowners are Michael & Gloria Gunlogson, Howard Torke, Chad & Vanessa Torke, Thomas O. Isaackson, John Wayne Murphy, Fagen Farms LLP, Lauris Cole, Otis C. Torke, Orlen Torke, Wayne & Deborah Carlson, Eric Pruess, Elvera Cole, Diane Kosen Johnson, Irene Timm, Lowell Hellie, Christopher Long, Casey Long, Kevin Arneson, Dennis Stelter, Rachel Hagen, Ken & Timothy Isaackson, Yellow Medicine County and Sandnes Township.

* Portions of Townships 1, 2, 11 and 12 in Lucas Township in Lyon County. Landowners are Steve & Sandra Boerboom, Marie & Elton

Nelson, Ken Isaackson, Thomas Isaackson, Steven & Jane Remiger, Dale & Debra Louwagie, Kim & Carolyn Runholt, Kenneth & Sandra Isaackson, Norman Nelson, Lyon County and Lucas Township.

A brief description of the Improvement to Judicial Ditch 3 YM&L Main and Branch E Imp. consists of the following:

Main: Starting point at approximately 600 ft. north of the Yellow

Medicine and Lyon County line on 510 th Street in Yellow Medicine county. General course approximately following the existing main in a northwesterly course to the NW corner of the SE 1/4 quarter located in Section 35 Sandnes Township.

Branch E: Starting in NW 1/4 of the SE 1/4 Section 35 Sandnes Township and the terminus with the Main tile following a general course to the southwest, approx. 1000 feet and then turning South and traveling about 1300 feet into the NW1/4 of the NE 1/4 Section 2 Lucas TWP in Lyon County.

The engineer has submitted and filed his final detailed survey report to the Drainage Authority. The property owner’s report and the viewers’ report for the improvement and redetermination of benefits have been submitted and filed and the petition is still pending.

The drainage authority will also hear a detailed survey report prepared by the engineer discussing separable maintenance costs to the rest of the drainage system of Judicial Ditch 3 YM&L Main and Branch E

petition as in Minnesota Statute 103E.215 Subd. 6.

You are further notified that a public hearing has been ordered to be held in the Lyon County Law Enforcement Conference Room at the Lyon County Government Center, 607 W. Main Marshall, MN on Wednesday June 18th at 8:oo a.m. The purpose of the hearing is to consider the engineer’s final report for the Improvement to Judicial Ditch 3 YM&L Main and Branch E Petition and to accept the viewers’ report, property owners’ report, and determine a proportionate cost of separable maintenance.
